Censor Board May Approve Kangana Ranaut’s ‘Emergency’ Post Edits: High Court Update


Mumbai: In a significant update from the Bombay High Court, the Central Board of Film Certification (CBFC) has indicated that a certification for Kangana Ranaut’s highly anticipated film “Emergency” is on the horizon, contingent upon several recommended cuts being implemented. This announcement, made on Thursday, is a potentially pivotal moment for the film that has been entangled in a protracted struggle with the censor board over certification issues ahead of its scheduled release.

The biographical drama, focusing on former Prime Minister Indira Gandhi, has been a point of contention with the CBFC. Kangana Ranaut, who not only portrays the central role but also directs and co-produces the project, has accused the CBFC of deliberately delaying the film’s certification. According to her, the board’s procrastination seemed like an attempt to push back the release date originally slated for September 6.

Adding to the film’s tribulations, “Emergency” has faced opposition from various Sikh organizations, including the Shiromani Akali Dal. These groups have raised serious objections regarding the alleged misrepresentation of the Sikh community and historical inaccuracies presented in the film. The controversy appears to have deepened as these objections gained traction.

Responding to the ongoing delay, a division bench comprising Justices B P Colabawalla and Firdosh Pooniwalla delivered a stern rebuke to the CBFC last week. The court emphasized that the censor board could not remain indecisive as such delays encroach upon the fundamental right to freedom of speech and expression. The bench ordered the CBFC to make a definitive decision by September 25.

The film’s co-producer, Zee Entertainment Enterprises, took the matter to the Bombay High Court, seeking judicial intervention to expedite the certification process. During Thursday’s session, the bench inquired whether the CBFC had any “good news” to report regarding the film’s certification.

Representing the CBFC, counsel Abhinav Chandrachud confirmed that the revising committee had reached a decision.

. Chandrachud stated, “The committee has suggested some cuts before the certificate can be issued and the movie released.” Following this, Senior Counsel Sharan Jagtiani, representing Zee Entertainment, requested additional time to decide whether to comply with the recommended cuts.

Subsequently, the court rescheduled the matter for further hearing on September 30. Zee Entertainment, in its plea, has contended that while the CBFC had technically completed the certification process, it was inexplicably withholding the certificate. This allegation has fueled speculation that the delay could be politically motivated, particularly in light of the impending elections in Haryana.

Last week, Zee Entertainment asserted that the certification was being stalled due to political influences. The bench expressed bewilderment over why the ruling party would seemingly act against Kangana Ranaut, a known BJP MP, adding another layer of complexity to the issue.

As the court deadline of September 25 nears, all parties await a resolution that may significantly affect the film’s release timeline. Should the CBFC and the filmmakers reach an agreement on the suggested edits, this could pave the way for the much-anticipated release of “Emergency.”

The court’s insistence on a clear decision by the censor board is rooted in the importance of upholding constitutional rights. The debate over the film’s content highlights the ongoing tension between creative expression and societal sensitivities.
